American Indian Builders and Suppliers, Inc. must follow the
following guidelines to remain certified as a MBE, DBE and WBE supplier.
- Managerial Control

The owner must display clearly their control over principle,
management responsibilities - for example, the authority of negotiation of
contract and signature authority for banking services.
Any agreement for support services must be free of language that lessens or
impairs the ability of the owner to control or manage the business.

- Operational Control

The owner must have the demonstrable ability to exercise
operational control over the activities of the firm.

- Suppliers (Regular Dealers)

A Supplier is a firm that owns, operates, or maintains a
store, warehouse, or other establishment in which the materials or supplies
required for the performance of the contract are bought, kept in stock, and
regularly sold to the public in the usual course of business. It is a firm
that engages in, as its principle business, and in its own name, the
purchase and sale of the products in question.
The DBE, MBE and WBE Supplier must assume the actual and contractual
responsibility for the provision of the materials and supplies.

- Commercially useful function

The prime contractor is responsible for ensuring that DBE,
MBE and WBE performing work on the contract perform a commercially useful
function. A DBE, MBE and WBE is considered to perform a commercially useful
function when it is responsible for the execution of a distinct element of
work on a contract and carries out his responsibilities by actually
performing, managing, and supervising the work involved in accordance with
normal industry practice.
